Born in Edinburgh. His father was Waller Hugh Paton RSA (1828-1895), landscape painter and his uncle was Sir Joseph Noel Paton (1821-1901), painter. His obituary in the 'Scotsman' on 1 January 1941 stated he: 'died in Edinburgh on Wednesday..eldest son of Waller Hugh Paton RSA...attended the School of Art [ie formerly School of Design] and the RSA life class' etc.
